These Terms of Service govern your access to and use of Vaulted (the "Service"), operated by Aidan Santiago ("Vaulted," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
Vaulted is a software platform that helps private and hard money lenders track loans, log payments, manage construction draw requests, communicate with borrowers, and generate documentation using AI-assisted tools.
Vaulted is not a lender, broker, loan servicer, financial institution, or investment advisor. We do not originate, fund, underwrite, service, or guarantee any loan. All lending decisions, loan terms, and borrower relationships are entirely between the Lender and Borrower and are not facilitated, brokered, or guaranteed by Vaulted in any way.
You must be at least 18 years old and capable of forming a legally binding contract to use the Service.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Vaulted offers subscription plans (Solo, Operator, and Fund) at the pricing displayed on our website. New accounts receive a 60-day free trial with no credit card required. Subscriptions renew automatically until cancelled. You may cancel at any time through your account settings.
You agree not to use the Service for any unlawful purpose including violating usury laws or lending without required licensure, enter false or fraudulent loan information, attempt to access another user's account or data without authorization, or use the Service to harass or unlawfully contact any Borrower.
You are solely responsible for complying with all applicable federal, state, and local laws governing private and hard money lending in your jurisdiction, including licensing requirements, usury limits, disclosure obligations, and fair lending laws. Vaulted does not provide legal, tax, or financial advice.
Borrowers accessing the borrower portal do so at the invitation of a Lender. The relationship, loan terms, and any obligations between a Borrower and Lender exist independently of Vaulted.
Vaulted's AI-powered features are provided for informational and productivity purposes only. AI-generated content does not constitute legal, financial, tax, or investment advice, and does not constitute an underwriting decision, credit approval, or guarantee of any kind. You remain solely responsible for all decisions made using information generated by the Service.
Vaulted and its original content, branding, and functionality are owned by Aidan Santiago and protected by applicable intellectual property laws. Loan data and documents you upload remain your property.
We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT ANY AI-GENERATED OUTPUT WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAULTED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSSES ARISING FROM LENDING DECISIONS MADE USING THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Vaulted from any claims arising from your use of the Service, your lending activity, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Massachusetts, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration on an individual basis.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
